The Court was persuaded that the client’s youth, lack of prior offending, demonstrated remorse and extenuating circumstances warranted an outcome without conviction.
The Court imposed a 12-month Conditional Release Order without conviction and made no order for licence disqualification.
The client’s existing police-imposed licence suspension remained in place.
Drive Whilst Licence Suspended
The client appeared before Liverpool Local Court after pleading guilty to driving whilst their licence was suspended.
Despite the offence carrying a maximum penalty of 6 months imprisonment and/or a $3,300 fine , the Court imposed a 12-month Conditional Release Order without recording a conviction .
Mobile Phone Offence
The offence was proven but dismissed without conviction under s 10(1)(a) .
The client avoided having a conviction recorded despite pleading guilty to the offence.
